What is Personal Information?

Personal Information is any information that is identifiable with you. This information may include but is not limited to your name, mailing address, phone numbers, gender, email address, identification numbers, etc. Personal Information, however, does not include your name, business title or business address and business telephone number in your capacity as an employee of an organization.

How do we collect your personal information?

We will always collect your personal information by fair and lawful means (for example, when you complete a contest ballot form or submit a promotional product request form). We often collect personal information from you and from third party service providers, where we have obtained your consent to do so or as otherwise permitted by law.

Do we collect or use information collected from you with technology on our websites?

The Kellogg Site collects some information about you using technology, so it may not be readily apparent to you that it is being collected. For instance, when you come to our Site your IP address is collected so that we know where to send information you are requesting. An IP address is often associated with the place from which you enter the Internet like your Internet Service Provider (ISP), your company or your university. This information is not personally identifiable. The Kellogg Site uses information collected through technology to make our Site more interesting and useful to you.

"Cookie" Technology

What are cookies?

"Cookies" are data files that a website sends to your computer while you are viewing the site. These data files include information that allows our sites to remember important information that will make your use of the site more efficient and useful to you. Our sites use cookies for a variety of purposes. Kellogg may use "cookie" technology and IP addresses to obtain non-personal information from its on-line visitors, and also to provide registered visitors with the best possible personalized on-line experience.

How does Kellogg use cookies?

The cookie tracks the total number of visitors to our sites in an "aggregate" form (in other words, the personal information of the individual is pooled into a group of such information such that the personal information cannot be identified with that individual). We do not extract personal information in this process nor do we disclose this information other than to other members of the Kellogg group of companies. Cookies are a tool to allow us to update and improve our sites.

How do we use your personal information?

We identify the purposes for which we use your personal information at the time we collect such information from you and obtain your consent, in any case, prior to such use. One of the primary purposes for which we collect your Personal Information is to respond to product complaints, product nutritional information and recipe requests, and product injury claims with respect to injuries suffered by you as a result of our products. We often collect your Personal Information to fulfil promotional/contest inquiries and send prizes to winners of contests operated by us and by third parties on our behalf. We may also use your personal information as otherwise permitted by law.

To whom do we provide your personal information?

We identify to whom, and for what purposes, we disclose your personal information, at the time we collect such information from you and obtain your consent to such disclosure. For example, we may disclose your personal information:

(a) to third party service providers with whom we have a contractual agreement, which includes appropriate privacy standards, for the purpose of (i) fulfilling promotional product requests and sending prizes to winners of contests run by us and contests run by third parties on our behalf; (ii) performing functions such as data processing, database services or information technology support on our behalf; (iii) providing insurance for our product liability claims on our behalf and (iv) marketing or providing any of our products;
 (b)  such other disclosures of personal information to such persons for which you provide your consent; and
 (c)  as otherwise permitted by law.

When and how do we obtain your consent?

We obtain your consent prior to collecting, and in any case, prior to using or disclosing your personal information for any purpose. You may provide your consent to us either orally or in writing. For example, when you submit a contest ballot form to our redemption house, you provide your consent to allow the redemption house to disclose the information in the ballot form to us so that we may identify you as a contest winner. From time to time, we may collect, utilize or disclose your personal information based on your consent and as permitted by law.

We ensure that all our affiliates and other third parties which are engaged to perform services on our behalf and are provided with personal information are required by contract to observe the intent of this Privacy Statement and our Privacy Policy and Practices.

We will ensure that your Personal Information is kept as accurate, complete and up-to-date as possible. We will not routinely update your Personal Information, unless such a process is necessary. If you successfully demonstrate that the personal information we have on you is inaccurate or incomplete, we will amend the Personal Information as required. Where appropriate, we will transmit the amended information to third parties having access to your personal information.

How fast will we respond to your written requests?

We will attempt to respond to each of your written requests not later than thirty (30) days after receipt of such requests. We will advise you in writing if we cannot meet your requests within this time limit. You have the right to make a complaint to the federal Privacy Commissioner in respect of this time limit.

Are there any costs to you for requesting information on your personal information or on our Privacy Policy or Practices?

We will not assess any costs to you for access to your personal information or on our Privacy Policy or Practices without first providing you with an estimate of the approximate costs, if any. You may withdraw your requests for access to information by notifying us within the thirty-day notice period disclosed on the estimate. If you do not notify us within5:43 PM 1/10/2009 such thirty-day period, we will send you a further notice indicating that you will be deemed to have withdrawn your request for access unless you advise us otherwise within thirty days. If after the expiry of this thirty day period, you have not so advised us, we will deem your request to have been withdrawn and provide you with written notice to that effect.

What type of security do we provide on our websites?

The importance of security for all personal information collected through the website is of utmost concern to us. We have taken technical, contractual, administrative and physical security steps to protect the personal information collected from you on the Kellogg websites with a level of security appropriate to the sensitivity of the personal information collected. For example, if and when you provide credit card information, we use secure socket layer (SSL) encryption to protect it. These security measures are periodically reviewed. However, there are some things that users can do to help protect the security of this personal information as well. For instance, each user should never give out their password. Also, every user should to sign out of their internet account and close their browser window when they finish surfing the Web so that other people using the same computer won't have access to their information.
